Privacy policy

1. Preamble

This privacy policy informs Site users how their personal data is collected and processed, in accordance with Regulation (EU) 2016/679 of 27 April 2016 ("GDPR") and French Act No. 78-17 of 6 January 1978 on data processing, files and freedoms, as amended.

By using the Site and submitting your data, you acknowledge having read this policy.

2. Data controller

The data controller is Farm-3D, a SAS registered with the Valenciennes Trade and Companies Register under number 982 713 901, with registered office at La Citadelle des Savoir-Faire, 83 rue des Mines Innovantes, 59860 Bruay-sur-l'Escaut, France.

Farm-3D has not appointed a data protection officer, as such an appointment is not mandatory under Article 37 GDPR given the nature and volume of the processing carried out. Requests concerning personal data are handled at the address above.

3. Data collected

Farm-3D collects only the data strictly necessary for the purposes described below, in line with the data-minimisation principle.

Via the contact form: name, organisation, email address and message content. These fields, except the organisation, are required to handle your request.

Technical connection data: when browsing the Site, certain technical data (IP address, connection logs) may be processed for security and proper operation of the service.

No data belonging to special categories (so-called "sensitive" data) is requested or processed.

4. Purposes and legal bases

Handling and following up contact requests: the legal basis is your consent (Article 6.1.a GDPR), expressed by voluntarily submitting the form, as well as Farm-3D's legitimate interest in responding to enquiries addressed to it (Article 6.1.f).

Security and proper operation of the Site: the legal basis is Farm-3D's legitimate interest (Article 6.1.f).

No decision producing legal effects is taken solely on the basis of automated processing, and no profiling is carried out.

5. Data recipients

Your data is intended only for authorised Farm-3D staff in charge of handling your request.

It may be shared with processors acting on behalf of and on the instructions of Farm-3D, under agreements compliant with Article 28 GDPR:

— OVH SAS (2 rue Kellermann, 59100 Roubaix, France), for hosting the Site and the technical delivery of messages;

— Google Ireland Limited (Gordon House, Barrow Street, Dublin 4, Ireland), for the business email service used to receive and handle contact requests.

Your data is never sold, rented or transferred to third parties for commercial purposes.

6. Transfers outside the European Union

Farm-3D favours processors located within the European Union: the Site is hosted in France and the email service is contracted with an entity established in Ireland.

As the email provider belongs to a group established in the United States, transfers outside the European Union may occur. These are governed by the appropriate safeguards set out in Articles 44 et seq. GDPR, in particular the European Commission's standard contractual clauses and the EU–US Data Privacy Framework.

7. Retention period

Contact-request data: kept for as long as necessary to handle the request, then for three (3) years from the last contact for business-relationship follow-up purposes, in line with CNIL recommendations, unless an earlier deletion request is made.

Technical connection data: kept for a period not exceeding twelve (12) months, in line with applicable recommendations.

8. Your rights

In accordance with the GDPR and the French Data Protection Act, you have the following rights over your data: access, rectification, erasure, restriction of processing, objection, portability, as well as the right to withdraw your consent at any time and to set directives regarding the fate of your data after your death.

You may exercise these rights by writing to christophe@farm-3d.com, providing proof of identity. Farm-3D undertakes to respond within one (1) month of receiving the request.

You also have the right to lodge a complaint with the French Data Protection Authority (CNIL), 3 Place de Fontenoy, 75007 Paris - www.cnil.fr.

9. Security

Farm-3D implements appropriate technical and organisational measures to ensure a level of security appropriate to the risk and to protect your data against destruction, loss, alteration, unauthorised disclosure or access.

10. Changes

Farm-3D reserves the right to amend this privacy policy at any time to reflect legal, regulatory or technical developments. The applicable version is the one in force at the date of your visit to the Site.
